INFORMACIÓN GENERAL: No es necesario comprar. No es válido fuera del área geográfica terrestre de recepción de la señal de transmisión de KXTX-TV y donde esté prohibido. El Sorteo KXTX-TV CLINICAS DE BEISBOL CON LOS TEXAS RANGERS Y OZARKA (“Sorteo”) comienza el 26 de junio 2008 a las 3.00 de la tarde y finaliza el 2 de julio 2008 a las 11.59 de la noche (el “Período del Sorteo”). Todas las horas de este Sorteo están indicadas como Horas Estándar del Centro de los EE.UU. (“CST” por su sigla en inglés). Las probabilidades de ganar dependen del número de inscripciones elegibles recibidas.

PARA INSCRIBIRSE: visite el sitio Web de Telemundo 39 ubicado en http://www.telemundodallas.com haga clic en el icono del SORTEO KXTX-TV CLINICAS DE BEISBOL CON LOS TEXAS RANGERS Y OZARKA™ el cual le llevará al formulario de inscripción del Sorteo, llene y después transmita el formulario de inscripción incluyendo su/s nombre/s y apellido/s, dirección, número de teléfono, dirección de correo electrónico y fecha de nacimiento. Las Inscripciones pasan a ser propiedad de KXTX-TV NBC Universal, Inc., Texas Rangers Baseball Partners, conjuntamente los (“Patrocinadores”), no se acusará su recibo y no serán devueltas.

Las Inscripciones deberán ser recibidas antes de las 11.59 de la noche del 2 de julio 2008 para ser elegibles al Sorteo. Podrá inscribirse una vez por día durante el Periodo del Sorteo. Las inscripciones adicionales excediendo los límites establecidos aquí, serán anuladas. Las Inscripciones presentadas con software de repetición automática o cualquier otro mecanismo, ente o dispositivo automatizado serán descalificadas. Las Inscripciones incompletas, ilegibles, alteradas o incoherentes por cualquier motivo, incluyendo pero no limitado a fallas de computadoras o congestión de redes serán descalificadas y no serán aceptadas. En caso de disputa sobre la identidad de un participante que haya presentado una inscripción potencialmente ganadora, los Patrocinadores se reservan el derecho a considerar que la inscripción fue hecha por el titular autorizado de la cuenta de correo electrónico usada al momento de la inscripción. La inscripción constituye autorización (excepto donde lo prohíba la ley) para usar nombre/s y apellido/s, ciudad, estado, parecido, semejanza, imagen y/o voz del ganador en campañas publicitarias, promociones y propaganda sin compensación adicional.

ELEGIBILIDAD: abierto solamente a los residentes legales permanentes de los EE.UU. mayores de 18 años de edad al comienzo del Periodo del Sorteo que estén residiendo y físicamente localizados en el área geográfica terrestre de recepción de la señal de transmisión de KXTX-TV en el estado de Texas, dentro de los condados de Anderson, Bosque, Collin, Comanche, Cook, Dallas, Delta, Denton, Ellis, Erath, Fannin, Freestone, Hamilton, Henderson, Hill Hood, Hopkins, Hunt, Jack, Johnson, Kaufman, Lamar, Navarro, Palo Pinto, Parker Rains, Red River, Rockwall, Sommervell, Tarrant, Van Zandt y Wise. Los funcionarios, directivos y empleados de las Entidades del Sorteo y sus familiares cercanos (esposos, padres y madres, hijos e hijas, y hermanos y hermanas y sus esposos) y/o toda persona habitando en la misma residencia con aquellos, estén o no emparentados, no son elegibles para inscribirse en el Sorteo. Las Entidades del Sorteo, tal y como se las menciona aquí, incluyen los Patrocinadores, Internet Broadcasting Systems, Inc. y Texas Rangers Baseball Partners, Ozarka, junto a sus respectivas casas matrices, empresas subsidiarias y afiliadas y agencias administrativas, de publicidad y promoción y cualquier otra entidad participando en el desarrollo, administración, promoción o implementación del Sorteo.

SELECCIÓN DEL GANADOR Y ELEGIBILIDAD: El ganador será seleccionado durante un sorteo al azar realizado por empleados de los Patrocinadores de entre todas las inscripciones elegibles recibidas alrededor del 3 de julio 2008. Los Patrocinadores harán dos (2) intentos por notificar al ganador llamando al número de teléfono o enviando un correo electrónico a la dirección de correo electrónico proporcionada al momento de la inscripción. Se podrá exigir al ganador que firme y devuelva relevos de elegibilidad y responsabilidad y, excepto donde esté prohibido, un relevo de publicidad, conjuntamente referidos aquí como los “Documentos del Sorteo” dentro de los 3 días de dicha notificación. El incumplimiento de este requisito dentro del tiempo establecido resultará en descalificación y se seleccionará a un ganador sustituto de entre las inscripciones elegibles restantes. Si no se puede localizar al ganador, o si se descubre que ese ganador es inelegible o no puede o no desea cumplir con estas Reglas Oficiales, o si su notificación de premio es devuelta porque no pudo ser entregada, el ganador será descalificado y se seleccionará a un ganador sustituto de entre las demás inscripciones elegibles recibidas. Limitado a un premio por familia o residencia familiar.

PREMIO: se otorgarán un total de diez (10) premios. Cada uno de los ”Premios” incluirá entradas para un ganador y nueve (9) invitados a la clínica de béisbol de los Ozarka/Texas Rangers (“Clínica”). Los invitados deberán tener entre 9 y 12 años de edad. La clínica se hará en el Dr. Pepper Youth Ballpark en Arlington, TX (si llueve se hará bajo techo en el Arlington Ballpark) los días 7 de julio 2008 entre las 10.00 de la mañana y 12.00 del mediodía y 8 de julio 2008 entre las 1:00 y 3.00 de la tarde. Durante la clínica, los ganadores tendrán oportunidad de conocer personalmente a algún jugador y/o entrenador de los Texas Rangers y/o al señor Luís Fernando Pérez y recibirán doce (12) entradas a algún juego de béisbol de los Texas Rangers (fechas y entradas sujetas a términos y condiciones a exclusiva discreción de los Patrocinadores) y doce (12) camisetas (tamaños para niños solamente). La primera tanda de cinco (5) ganadores seleccionados recibirán entradas a la clínica entre las 10.00 de la mañana y las 12.00 del mediodía 7 de julio 2008 y la segunda tanda de cinco (5) recibirán entradas a la clínica entre la 1.00 y las 3.00 de la tarde del 8 de julio 2008.

El Valor Minorista Calculado (“ERV” por sus siglas en inglés) del premio es de $800.00. El ERV de todos los Premios (diez en total) es de $8,000.00.

Los ganadores recibirán un formulario 1099 del Servicio Interno de Rentas de los EE.UU. (“IRS” por sus siglas en inglés) enviado por los Patrocinadores por el valor minorista total calculado de su premio en el año en que este haya sido ganado.

Los Patrocinadores controlarán todos los detalles del premio a su exclusiva discreción y se reservan el derecho a sustituir el premio (o parte del premio) por otro de igual o mayor valor. Los impuestos y demás gastos, costos o tasas relacionadas con la aceptación y/o uso de cualquier premio son responsabilidad exclusiva de los ganadores. Los premios no podrán ser transferidos por los ganadores o cambiados por dinero en efectivo y son válidos solamente por los servicios detallados arriba, sin sustitución de premio permitida al ganador. En caso que el premio no sea reclamado, será perdido y se seleccionará a un ganador sustituto de entre las inscripciones elegibles restantes. Si alguna parte del premio no está disponible por cualquier motivo, entonces las demás partes del mismo constituirán cumplimiento pleno de la obligación de los Patrocinadores hacia el ganador, y no se adjudicará compensación adicional.

Los premios ganados por menores de edad serán adjudicados a nombre de sus padres o tutor legal.

Los Patrocinadores no tendrán obligación de ni serán responsables por cancelaciones, retrasos o cualquier otro cambio hecho por cualquier compañía o persona proveedora de cualquier parte del premio debido a motivos fuera de su control (de los Patrocinadores) o gastos incurridos como consecuencia de los mismos. La fecha y hora del evento están sujetas a cambios. El evento está sujeto a cancelación. Si un ganador elige asistir al evento sin invitados o con menos de 9 invitados, las demás partes del premio constituirán cumplimiento pleno de la obligación de los Patrocinadores hacia ese ganador y no se adjudicará ninguna compensación adicional. Se podrá exigir a los invitados, de haberlos, que firmen y devuelvan relevos de responsabilidad y, excepto donde esté prohibido, relevos de publicidad referidos aquí como “Documentos del Invitado”, los cuales deberán ser devueltos junto a los Documentos del Sorteo o el Premio será perdido y se podrá seleccionar a un ganador sustituto de entre las inscripciones elegibles restantes. Si alguno de los invitados es menor de edad, el ganador u otro de los invitados deberá ser su padre, madre o tutor legal y firmar y devolver los Documentos del Invitado en su nombre.

CONDICIONES: inscribiéndose en este Sorteo los participantes acuerdan, en nombre propio y en representación de sus herederos, albaceas y administradores, (a) a relevar y amparar a las Entidades del Sorteo y a sus respectivos funcionarios, directivos y empleados (conjuntamente las “Partes Relevadas”) contra toda responsabilidad, enfermedad, lesión, muerte, pérdida, litigio o daño que pudiera ocurrir, directa o indirectamente, con o sin negligencia, de la participación del participante en este Sorteo y/o su aceptación, posesión, buen o mal uso del premio o de cualquier parte del premio; (b) a indemnizar a las Partes Relevadas contra cualquier y toda responsabilidad resultando o surgiendo del Sorteo, y, por el presente documento, reconocer que las Partes Relevadas no han hecho ni son responsables de ningún modo por extender garantía alguna, implícita o explicita, de hecho o en ley, relacionada con los premios incluyendo garantías extendidas exclusivamente por el proveedor de premios entregadas junto al premio; (c) de ser elegido ganador, a permitir la publicación de su/s nombre/s y apellido/s en www.sweepstakeswebsite.com y todo uso que las Partes Relevadas hagan de su/ nombre/s y apellido/s, voz, imagen y/o parecido y semejanza en campañas publicitarias, promociones y publicidad sin compensación adicional y, a solicitud, consentir, por escrito a tal uso y (d) a regirse según estas Reglas Oficiales y renunciar a cualquier derecho a reclamar ambigüedad o error en estas Reglas Oficiales, o en el propio Sorteo, y respetar las decisiones de los Patrocinadores las cuales son vinculantes y finales en todos los sentidos. El incumplimiento de estas reglas podrá resultar en la descalificación de esta promoción.

CONDICIONES ADICIONALES: Los Patrocinadores se reservan el derecho a cancelar este Sorteo o a descalificar permanentemente de cualquier promoción a cualquier persona bajo sospecha de haber violado intencionalmente estas reglas. Cualquier sabotaje o intento de sabotaje contra el Sorteo o contra su operación normal es un acto ilegal y queda sujeto a proceso legal por parte de los Patrocinadores, quienes podrán demandar, a su exclusiva discreción, por daños y perjuicios y en la medida máxima permitida por la ley. El incumplimiento por parte de los Patrocinadores de cualquier disposición de estas Reglas Oficiales debido a caso fortuito, huracán, guerra, incendio, disturbio civil, terremoto, amenaza o hecho terrorista, acciones de enemigos públicos, acciones de entes de gobierno fuera del control de los Patrocinadores (excepto el cumplimiento de códigos y regulaciones vigentes) u otros casos de fuerza mayor, no serán considerados violación de estas Reglas Oficiales. Las Partes Relevadas no asumen ninguna responsabilidad por daños a la computadora del participante o de terceros, relacionados con o resultando de la inscripción, o de bajar materiales o software en conexión con este Sorteo. Las Partes Relevadas no son responsables por fallas en las telecomunicaciones o redes, o por fallas electrónicas, técnicas o de computadoras de ningún tipo, por trascripción inexacta de información de inscripción, errores en cualquier material promocional o de mercadeo, errores en estas reglas, por errores humanos o electrónicos, o por inscripciones robadas, mal dirigidas, confusas, retrasadas por transmisiones de computadoras, perdidas, dañadas o devueltas. Los Patrocinadores se reservan el derecho, a su exclusiva discreción, a cancelar o modificar el Sorteo (incluyendo sin limitaciones estas Reglas Oficiales) sin notificación, de cualquier manera, y por cualquier motivo (incluyendo, sin limitaciones, en caso de algún incidente inesperado que no esté completamente contemplado en estas Reglas Oficiales). En caso de cancelación, modificación o suspensión, los Patrocinadores se reservan el derecho a seleccionar a los ganadores en un Sorteo al azar de entre todas las inscripciones elegibles que no estén bajo sospecha recibidas en el momento que ocurra el hecho que provoca la cancelación, modificación o suspensión. La notificación de tal cancelación, modificación o suspensión será publicada en el sitio Web http://www.telemundodallas.com. Los Patrocinadores podrán prohibir a cualquier participante, o participante potencial, de participar en el Sorteo si no respeta estas Reglas Oficiales, o si actúa con la intención de molestar, abusar, amenazar o acosar a otro participante, a los Patrocinadores o sus agentes o representantes, o si su conducta es perjudicial (tal y como lo interpreten los Patrocinadores a su exclusiva discreción).

SI UN CONFLICTO O RECLAMO NO PUEDE SER RESUELTO POR CONVERSACIONES DIRECTAS O MEDIACIÓN, SERÁ RESUELTO MEDIANTE ARBITRAJE FINAL Y VINCULANTE ADMINISTRADO POR JUDICIAL ARBITRATION AND MEDIATION SERVICES, INC., (“JAMS” POR SU SIGLA EN INGLÉS) SEGÚN SUS REGLAS Y PROCEDIMIENTOS SIMPLES O SEGÚN VERSIONES POSTERIORES DE LAS MISMAS (“REGLAS JAMS”). LAS REGLAS JAMS SERÁN RESPETADAS PARA PROCESO DE SELECCIÓN DE ÁRBITRO, EXCEPTO QUE DICHO ÁRBITRO DEBERÁ TENER EXPERIENCIA LEGAL Y LICENSIA PARA PRACTICAR DERECHO EN LA FLORIDA. LOS JUICIOS INICIADOS SEGÚN ESTE PÁRRAFO TOMARÁN LUGAR EN EL CONDADO DE MIAMI-DADE. KXTX-TV CLINICAS DE BEISBOL CON LOS TEXAS RANGERS Y OZARKA (“Sweepstakes”) begins on June 26, 2008 at 3 P.M. and ends on July 2, 2008at 11:59 P.M. (Sweepstakes Period”). All times in the Sweepstakes refer to Central Time. Odds of winning depend upon the number of eligible entries received.

TO ENTER: To enter, access the Telemundo 39 Web Site at http://www.telemundodallas.com, click on the KXTX-TV CLINICAS DE BEISBOL CON LOS TEXAS RANGERS Y OZARKA™ SWEEPSTAKES icon which will take you to the Sweepstakes entry form, then complete and thereafter transmit the entry form, which includes name, address, telephone number, email address and date of birth. All entries become the property of KXTX-TV NBC Universal, Inc., Texas Rangers Baseball Partners, collectively, “Sponsors”, and will not be acknowledged or returned.

Entries must be received before 11:59 P.M. on July 2, 2008 to be eligible for the Sweepstakes. You may enter once per day during the Sweepstakes Period. Multiple entries received from any person or email address beyond this limit will void all such additional entries. Entries generated by a script, macro, or other automated means will be disqualified. Entries that are incomplete, garbled, corrupted, or unintelligible for any reason, including, but not limited to, computer or network malfunction or congestion, are void and will not be accepted. In case of a dispute over the identity of an entrant who made a potentially winning entry, Sponsors reserve the right to deem that the entry was made by the registered subscriber of the email address submitted at the time of entry. Entry constitutes permission (except where prohibited by law) to use entrant's name, city, state, likeness, image, and/or voice for purposes of advertising, promotion, and publicity without additional compensation.

Entrants will have the opportunity to receive information from KXTX-TV and selected partners by checking the appropriate box. If, at any time, you no longer wish to receive materials from KXTX-TV please go to our privacy policy, located at http://www.telemundodallas.com and follow the procedures indicated.

ELIGIBILITY: Open only to permanent, legal U.S. residents who are physically located in the KXTX-TV terrestrial geographic viewing area in the counties of Anderson, Bosque, Collin, Comanche, Cook, Dallas, Delta, Denton, Ellis, Erath, Fannin, Freestone, Hamilton, Henderson, Hill Hood, Hopkins, Hunt, Jack, Johnson, Kaufman, Lamar, Navarro, Palo Pinto, Parker Rains, Red River, Rockwall, Sommervell, Tarrant, Van Zandt, and Wise in the state of Texas and who are 18 years of age or older, as of the start of the Sweepstakes Period. Officers, directors, and employees of Sweepstakes Entities, members of these persons’ immediate families (spouses and/or parents, children, and siblings, and their spouses), and/or persons living in the same households as these persons (whether or not related thereto) are not eligible to enter the Sweepstakes. Sweepstakes Entities, as referenced herein, shall include Sponsors, Internet Broadcasting Systems, Inc., and Texas Rangers Baseball Partners, Ozarka, and their respective parent, subsidiary, and affiliate companies and administrative, advertising, and promotion agencies and any other entity involved in the development, administration, promotion, or implementation of the Sweepstakes.

WINNER SELECTION AND NOTIFICATION: Winner will be selected in a random drawing by employees of Sponsors from all correct eligible entries on or about July 3, 2008. Sponsors will make two (2) attempts to notify winner(s) at the phone number and/or email address submitted at the time of entry. Winner may be required to execute and return an affidavit of eligibility, release of liability, and, except where prohibited, publicity release collectively, “Sweepstakes Documents” within 3 days of such notification. Noncompliance within this time period will result in disqualification, and an alternate winner may be selected from the remaining eligible entries. If winner cannot be reached, if he/she is found to be ineligible, if he/she cannot or does not comply with these Official Rules, or if his/her prize or prize notification is returned as undeliverable, winner will be disqualified and an alternate winner may be selected from the remaining eligible entries. Limit one (1) prize per family or household.

PRIZE: There will be a total of ten (10) prizes awarded. ”Prizes”, each consisting of the following: Entries for winner and nine (9) guests to the Ozarka/Texas Rangers baseball clinic (“Clinic”) Each guest must be between the ages of 9-12. The Clinic will be held at the Dr. Pepper Youth Ballpark in Arlington, TX (in case of bad weather, clinic will be held indoors at the Arlington Ballpark) on July 7, 2008, 10A.M. – 12P.M. and July 8, 2008, 1P.M. – 3P.M. . Winners will also have an opportunity to meet a current Texas Rangers player and/or coach and/or Luis Fernando Perez during the baseball clinic and will receive twelve (12) tickets to a Texas Rangers baseball game (game dates and tickets are subject to terms and conditions and subject to Sponsors’ sole discretion) and twelve (12) t-shirts (children sizes only). The first five (5) winners selected will receive entry to the Clinic from 1:00P.M. – 3:00P.M. on July 7, 2008 and the second five (5) winners selected will receive entry to the Clinic from 1:00 P.M. - 3:00 P.M. on July 8, 2008.

Estimated Retail Value (“ERV”) of Prize is $800.00. ERV of all Prizes is $8000.00.

Sponsors will furnish an Internal Revenue Service Form 1099 to Winner for the ERV of Prize for the tax year in which Prize was won.

Specifics of Prize will be determined by Sponsors in their sole discretion. Sponsors reserve the right to substitute a similar Prize (or Prize element) of equal or greater value. All taxes and other expenses, costs, or fees associated with the acceptance and/or use of Prize are the sole responsibility of Winner. Prize cannot be transferred by Winner or redeemed for cash and is valid only for the items detailed above, with no substitution of Prize by Winner. If Prize is unclaimed, it will be forfeited, and an alternate Winner may be selected from the remaining eligible entries. If a Prize element is not available for any reason, the remaining elements of Prize shall constitute full satisfaction of Sponsors' Prize obligation to Winner, and no additional compensation will be awarded.

Prizes won by minors will be awarded in the name of their parent or legal guardian.

Sponsors shall have no responsibility or liability for cancellations, delays, or any other change by any company or person providing any element of Prize due to reasons beyond Sponsors’ control, and are not responsible or liable for any expenses incurred as a consequence thereof. Date and/or time of Performance is subject to change. Performance is subject to cancellation. If Winner chooses to attend the Performance with fewer than9, or no, Guests, the remaining elements of Prize shall constitute full satisfaction of Sponsors’ Prize obligation to Winner and no additional compensation will be awarded. Guests, if any, may be required to execute and return releases of liability and, except where prohibited, publicity releases “Guest Documents”, which must be returned with the Sweepstakes Documents, or Prize will be forfeited and an alternate winner may be selected from the remaining eligible entries. If any Guest is a minor, Winner or one of the other Guests must be such minor’s parent or legal guardian and must execute and return the Guest Documents on such minor’s behalf.

CONDITIONS: By entering the Sweepstakes, each entrant agrees for entrant and for entrant’s heirs, executors, and administrators (a) to release and hold harmless Sweepstakes Entities and their respective officers, directors, and employees “Released Parties” from any liability, illness, injury, death, loss, litigation, or damage that may occur, directly or indirectly, whether caused by negligence or not, from such entrant’s participation in the Sweepstakes and/or his/her acceptance, possession, use, or misuse of Prize or any portion thereof; (b) to indemnify Released Parties from any and all liability resulting or arising from the Sweepstakes and to hereby acknowledge that Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to Prize, including express warranties provided exclusively by Prize supplier that are sent along with Prize; (c) if selected as a Winner, to the posting of such entrant’s name on www.sweepstakeswebsite.com and the use by Released Parties of such name, voice, image, and/or likeness for publicity, promotional, and advertising purposes without additional compensation, and, upon request, to the giving of consent, in writing, to such use; and (d) to be bound by these Official Rules and to waive any right to claim any ambiguity or error therein or in the Sweepstakes itself, and to be bound by all decisions of the Sponsors, which are binding and final. Failure to comply with these conditions may result in disqualification from the Sweepstakes].

ADDITIONAL TERMS: Sponsors reserve the right to permanently disqualify from any promotion any person they believe has intentionally violated these Official Rules. Any attempt to deliberately damage the Sweepstakes or the operation thereof is unlawful and subject to legal action by Sponsors, who may seek damages to the fullest extent permitted by law. The failure of Sponsors to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of Sponsors (excepting compliance with applicable codes and regulations), or other “force majeure” event will not be considered a breach of these Official Rules. Released Parties assume no responsibility for any injury or damage to entrants’ or to any other person’s computer relating to or resulting from entering or downloading materials or software in connection with the Sweepstakes.
